The Prime Minister’s help on political and public affairs Rana Sanaullah hinted on Tuesday that a reference can be filed against two judges of the Court of Apex Higher “on their conduct in certain cases”.
“Their (two judges SC) is to write letters on each problem … The letters make the titles and later reach the recipient,” the chief of the PML-N said on Tuesday while addressing a channel private information.
His remarks occurred one day after the Judicial Commission approved the appointment of six new judges before the Supreme Court in the midst of a boycott of the PTI legislators and two superior judges of the SC. The main judges of all high lessons, with the exception of the High Court of Lahore (LHC) were among the six judges appointed.
Earlier, three judges – of the Sindh, Balutchistan and Lahore – were transferred to the IHC, arousing serious criticism of the legal fraternity, including the judges of the IHC.
The five judges, contesting the seniority criteria, were of the opinion that the judges transferred from other high lessons should be an oath to reset their seniority.
Nevertheless, their representation was rejected by the chief judge of the IHC, Aamer Farooq, claiming that the new oath was not required because their seniority was calculated from the moment they took an oath in their respective high court and not on the date of their transfer.
Meanwhile, the PTI senator Hamid Khan said that the lawyer’s community would dispute the appointments of the six judges before the Superior Court and performed to continue the “protest movement”.
In addition, the three advice from the representative bar of the Federal Capital – Islamabad Bar Council (IBC), Islamabad High Court Bar Association (IHCBA) and Islamabad District Bar Association (IDBA) – announced the launch of a long step during the ‘Audience of the 26th amendment linked petitions.
Addressing the private news channel today, the PM assistant said that any act which has become the source of propaganda and has brought a bad reputation to the institution could be linked to a fault.
However, he said that this case never presented itself to the discussion at the meeting of the cabinet.
Without naming anyone, the chief of the PML-N in power said: “They hamper the operations of the Supreme Court … oppose everything and boycott or write letters.”
Recalling discord among the SC judges in the past, the assistant of the PM said that the judges of the Supreme Court were divided into groups of eight and seven. “The letter had been published in the media,” he added Without appointing a judge.
Responding to the secretary general of the PTI, Salman Akram Raja, on the controversy surrounding the transfer of the judges of the High Court to IHC, Sanaullah asked: “Is it written in the constitution that the reasons for the transfer should be mentioned?”
However, he said that the consent of the judge concerned was compulsory for the transfer.
In addition, Sanaullah said that the PML-N and the Pakistani people party (PPP) wanted to establish a constitutional court, as stipulated in the Charter of Democracy, signed in 2006.
“Pti (Pakistan Tehreek-e-insaf) agrees with Maulana Fazlur Rehman and presented a project for the 26th constitutional amendment … The constitutional bench was formed on the PTI proposal,” he added .
